{"id":16167,"date":"2022-09-30T07:26:00","date_gmt":"2022-09-30T14:26:00","guid":{"rendered":"https:\/\/peartreecanada.com\/?post_type=resources&#038;p=16167"},"modified":"2025-11-21T07:28:28","modified_gmt":"2025-11-21T15:28:28","slug":"response-to-budget-2022","status":"publish","type":"resources","link":"https:\/\/peartreecanada.com\/fr\/resources\/response-to-budget-2022\/","title":{"rendered":"Response to: Budget 2022 Tax Measures and Amendments to Support a Growing Economy, Draft Legislation Consultation"},"content":{"rendered":"\n<p><\/p>\n\n\n<p><span data-contrast=\"auto\">Five recommendations:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<ol>\n<li><span data-contrast=\"auto\">Qualified Person (QP) prescribed manner and form of certificate (the \u201cQP Certificate\u201d) \u2013 transitional provision for 2022 CMETC financings completed prior to the publication of the prescribed form as set out in ITA s.66(12.61) (e);<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:256}\">\u00a0<\/span><\/li>\n<li><span data-contrast=\"auto\">Absent fraud or gross negligence proven by the CRA, the QP Certificate certifying that the \u201cexpense will be incurred pursuant to an exploration plan that primarily targets critical minerals\u201d as set out in ITA s.66(12.61) (e) is uncontestable by the CRA;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:256}\">\u00a0<\/span><\/li>\n<li><span data-contrast=\"auto\">If recommendation 2 above is not accepted, then reformatting the CMETC as a subset of the broader METC;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:256}\">\u00a0<\/span><\/li>\n<li><span data-contrast=\"auto\">Increasing resource issuer tax compliance by amending the ITA Regulation s.6201.1(5)(c) definition of \u2018excluded obligations\u2019 so that issuers\u2019 obligations under the standard flow-through share tax indemnity contained in subscription agreements include (1) interest charged by the CRA to flow-through share subscribers and (2) that the indemnity obligation is a first charge against the assets of the issuer in priority to banks but always subordinate to government claims. This provision would apply to all flow-through offerings, not just those that otherwise quality for the CMETC.<\/span><span
