Ce dispositif permet aux soci\u00e9t\u00e9s du secteur des ressources naturelles d\u2019\u00e9mettre des actions ordinaires dites \u00ab accr\u00e9ditives \u00bb et de transf\u00e9rer les d\u00e9ductions fiscales et les cr\u00e9dits d\u2019imp\u00f4t li\u00e9s \u00e0 leurs activit\u00e9s d\u2019exploration aux souscripteurs initiaux. D\u2019embl\u00e9e, PearTree avait confirm\u00e9 le traitement fiscal de ceux-ci en obtenant des d\u00e9cisions anticip\u00e9es en mati\u00e8re d\u2019imp\u00f4t sur le revenu aupr\u00e8s de l\u2019ARC et de Revenu Qu\u00e9bec.<\/p>\n<p>En outre, ces arrangements ne pr\u00e9sentent \u00e9galement aucun risque de variation de cours des actions puisque celles-ci sont vendues \u00e0 la cl\u00f4ture. Si la vente n\u2019est pas confirm\u00e9e, la transaction est annul\u00e9e et les fonds de souscription retournent au souscripteur. Dans les faits, nos fournisseurs de liquidit\u00e9s ont toujours honor\u00e9 leur engagement et aucune de nos transactions n\u2019a d\u00fb \u00eatre annul\u00e9e.<\/p>\n<p>Sur le plan fiscal, le risque demeure pr\u00e9sent quoique limit\u00e9. Aux fins de l\u2019imp\u00f4t, les actions accr\u00e9ditives sont trait\u00e9es comme des parts de soci\u00e9t\u00e9 en commandite\u00a0: l\u2019\u00e9metteur du secteur des ressources naturelles est tenu de d\u00e9penser les fonds aux fins prescrites par la l\u00e9gislation fiscale, dont le carottage, qui repr\u00e9sente le plus important poste de d\u00e9penses. Si les fonds ne sont pas d\u00e9pens\u00e9s comme le prescrit la loi, l\u2019ARC pourrait \u00e9mettre un avis de nouvelle cotisation au souscripteur-donateur.<\/p>\n<p>En plus de 500\u00a0financements, PearTree n\u2019a eu que sept points en litige avec l\u2019ARC. Cela dit, le traitement de l\u2019IMR est aussi affaire de moment, et les charges li\u00e9es aux actions accr\u00e9ditives qui figurent dans nos analyses peuvent \u00eatre report\u00e9es ind\u00e9finiment sur toutes les sources de revenu futures, y compris les dispositions attendues \u00e0 la suite du d\u00e9c\u00e8s de la personne.<\/p>\n<p>Remarque\u00a0: L\u2019IMR ne s\u2019applique pas \u00e0 l\u2019ann\u00e9e de d\u00e9c\u00e8s.
